Payne charged with burglary

An Evarts man is facing charges including burglary after allegedly breaking into a vacant home by breaking out a window.

John Payne, 24, was arrested by Evarts City Police Officer Joseph Jones.

According to the arrest warrant obtained by Harlan County Sheriff’s Deputy Chris Brewer, Payne entered a vacant home by breaking out a window on Aug. 29. Payne was hired to maintain the lawn by the property owner and did not have permission to be inside the home and he did not have a key.

Payne was charged with second-degree burglary and third-degree criminal mischief. He was lodged in the Harlan County Detention Center on a $1,500 full cash bond.

In other police activity:

• Brandon Nantz, 34, of Wallins, was arrested on Sept. 28 by Harlan County Sheriff’s Deputy Danny Lewis. Nantz was charged with second-degree burglary and violation of a Kentucky EPO/DVO. He was lodged in the Harlan County Detention Center on a $5,000 full cash bond;

• Derek Cook, 52, of Cumberland, was arrested by Kentucky State Police Trooper Drew Wilson on Sept. 30. Cook was charged with theft by unlawful taking of a firearm and lodged in the Harlan County Detention Center on a $1,500 full cash bond;

• Roger Asher, 44, of Baxter, was arrested on Sept. 28 by Kentucky State Police Trooper Keith Lowe. Asher was charged with first-degree possession of a controlled substance, illegal possession of a legend drug, possession of marijuana and possession of drug paraphernalia. He was lodged in the Harlan County Detention Center on a $5,000 full cash bond;

• Jason Clem , 41, of Cawood, was arrested by Lowe on Sept. 28. He was charged with tampering with physical evidence and resisting arrest. Clem was lodged in the Harlan County Detention Center on a $5,000 full cash bond.
