A Cumberland man was sentenced to a total of three years in prison recently in Harlan Circuit Court for trafficking a controlled substance.

Aaron Amburgey, 26, appeared in front of Harlan Circuit Court Judge Kent Hendrickson for sentencing. Commonwealth’s Attorney Parker Boggs and Assistant Commonwealth’s Attorney Jonathon Lee handled the matter for the state.

According to the final judgment order, Amburgey entered a plea of guilty on June 14, 2017 to trafficking a controlled substance.

Amburgey was sentenced on a charge stemming from an indictment handed down by the grand jury on Aug. 1, 2016.

According to the indictment, Amburgey sold or transferred buprenorphine, a schedule III narcotic, on or about March 10, 2016.

The final judgment order states the court asked Amburgey and his attorney Cotha Hudson if there was any reason for the sentence to not be pronounced, giving Amburgey and his attorney the opportunity to make any statements on behalf of the defendant. No sufficient cause was given as to why the sentence should not be handed down.

The order additionally states the court found imprisonment necessary for the protection of the public for reasons including a substantial risk Amburgey would commit another crime during any probationary period, probation or conditional discharge would unduly depreciate the seriousness of the crime.

Hendrickson sentenced Amburgey to a total of three years in prison and remanded him into custody to begin his sentence.
